CLIENTS’ GENERAL CONDITIONS
CONFIRMATION OF ENGAGEMENT
Verbal confirmation by the Client will provisionally reserve the Client’s requested Artist(s). An agreement between the Client and Your DJ & More (YDJ) will only be formed by the Client’s payment, either with a deposit or full balance. While the payment is unpaid, YDJ reserves the right to release the Artist.
FUTURE ENGAGEMENTS
Any enquiries or further engagements between the Client and the Artist(s) resulting directly or indirectly from this engagement must be arranged through YDJ.
CANCELLATION
Any cancellation and amendments of this agreement must be notified in writing. YDJ cannot take responsibility for any misunderstanding arising through instructions given verbally only. In the case of cancellation or postponement of the event at which the Artist(s) is to perform, a cancellation fee will be required. Exact rate of cancellation fee varies, but is normally:
· Three months or more notice - 50% of the engagement fee
· Between one and three months’ notice - 75% of the engagement fee
· Less than one month’s notice - 100% of the engagement fee
ALTERNATIVE ARTIST
Should the Artist(s) be unable to attend for any unforeseen reason, YDJ will make all reasonable endeavours to ensure that replacement artist(s) are available, which replacement the Client either may accept or reject. In the event of rejection of the alternative offered, any deposit or payment made by the Client for the original artist will be refunded in full.
INSURANCE AGAINST NON-APPEARANCE OF ARTIST
The Client is advised to take out insurance cover against non-appearance of the artist where a specific or well-known artist is contracted and an alternative cannot be considered acceptable.
OVERTIME
Any extensions to contracted times are subject to an extra charge. Any additions, extensions or variations to the terms of this agreement will be negotiated through YDJ and discussions of fees are not to be entered into with the Artist(s), unless otherwise agreed. Overtime is normally charged on a pro rata basis.
PAYMENT TERMS
If payment or part-payment of the agreed fee is due before the engagement date, and the Client fails to meet these agreed payment terms, YDJ reserve the right to cancel the booking and to retain any deposit already paid.
DISCOUNTS
Any discounts agreed between YDJ and the Client shall cease to apply if there is any default by the Client in performance of its obligations under the Agreement.
INTEREST
If payment is not made at the agreed time, YDJ reserves the right to charge interest at a rate of 2% per month from the due date of payment of each invoice.
COMPLAINTS
In the event of any complaint for which a reduction of fee is requested, full details of the complaint are to be sent to YDJ in writing within three days of the event. A telephone call on the first working day following the event to explain any problems would also be appreciated.
DAMAGED EQUIPMENT
The client agrees that if any equipment provided by an artist to perform is damaged by the client and/or their guests they will be liable for the full repair/replacement cost of the damaged equipment at full RRP.
YDJ LIABILITY
In the event of any non-fulfilment of this Agreement by reason of events beyond the control of YDJ, the level of liability of YDJ is strictly limited to a maximum of the fee stated in this Agreement.
YDJ cannot be held liable for any loss or damage, including injury to reputation, suffered by the Client as a result of acts of the Client’s staff or guests. YDJ shall be under no liability unless due to its negligence or other failure under this Agreement or under the general law and YDJ shall be under no liability whatsoever in excess of £1,000.
YDJ has public liability insurance up to £5,000,000.
TERMINATION
This Agreement will terminate once the Services agreed have been provided.
LAW
The Law of England shall be applied.
